Hi all, I was wondering if anyone knows how easy it is to divide land. I heard Jack mention it is really easy to divide in Tx. and Az. I would like to know what other states are easy to deal with when dividing and exactly how one goes about dividing a parcel. Any thoughts or advice?
You can likely make an educated guess as to which states are more difficult to process a land division. IN GENERAL…the more regulatory ridden states with high development costs will be more difficult. States like California and New York come to mind. Likewise, states that are notably more free of regulation are often easier, states like Texas and the Dakotas come to mind. Another generalization is that states on the coasts tend to be more difficult in general while states in the middle of the country will tend to be easier.
It also depends on the specific county or City that you are in as they often have additional subdivision regulations that are established as a part of their subdivision and zoning ordinances. It often will depend on the size of the lots that you are creating or the number of lots you are creating. In California for example, it’s easier if you are creating 4 or fewer lots which is called a parcel map. More than that and the process is longer, more expensive, etc.
