Situation: Husband and wife purchased property in 1989. Wife passed away in 2017. Husband wants to sell land. Because the vesting deed does not explicitly indicate that husband and wife took title as joint tenants with right of survivorship (JTWROS), Colorado presumes ownership as tenants in common. As a result, the seller (husband) needs to go through probate with the wife’s estate to satisfy Colorado law (and the title company’s Title Commitment Schedule B Requirements).
Does anyone know of a good attorney in Colorado that could pull together a personal representative’s deed for not a ton of $$$? Has anyone else dealt with a similar situation and willing to offer any advice?
